The use of these Web sites is subjected to the Terms, which are legally binding between you and JOYA LIFE. By using these Web sites, you are indicating your acceptance to be bound by these Terms. JOYA LIFE reserves the right to modify these Terms at any time. The Terms will be published on the Web sites and the continued use of these Web sites constitutes acceptance of these modifications.

ACCEPTANCE OF THE TERMS AND CONDITIONS

If User considers that the Linked Sites contain unlawful, noxious, denigrating, violent or inadequate content, he may report this to JOYA LIFE at the following e-mail address: info@joya.life. Nevertheless, such notice will never imply the obligation of JOYA LIFE to remove the respective link, neither will it necessarily imply that JOYA LIFE is aware that the content of the Linked Site is unlawful, for the purposes of legislation in force.

All JOYA LIFE companies in the world (hereinafter JOYA LIFE) own all the right, title and interest in and to the Web sites and/or their applications (including the web pages and social networks) and their content (sui generis rights of databases), their graphic design (look & feel), subjacent computer programs (including source codes), as well as the various elements on the Web sites (texts, graphics, photographs, videos, music, etc.), and the development and implementation of the products and services that are available for the user, consumer or purchaser.

JOYA LIFE holds the copyrights for all the material, products or services on these Web sites, or have been duly authorized by a third party to use such material on the Web sites. Except for what is mentioned on this Agreement or on the websites, anything you send or publish on the websites and / or submit to JOYA LIFE, including ideas, knowledge, techniques, questions, comments, complaints and suggestions (collectively referred to as “Submissions”) is and will be treated as no confidential, and JOYA LIFE reserves an irrevocable royalty-free, worldwide right to use, copy, distribute, show, publish, sell, modify, adapt, rent, and create derivative works from these Submissions in any way, and translating, modifying, disassembling or decompiling such Submissions. Every submission will automatically become sole and exclusive property of JOYA LIFE, and will not belong to you anymore.

JURISDICTIÓN

Any claim or dispute related to the content of the Web sites will be submitted to the laws of The Republic of Panama, and with respect to the jurisdiction and location, only the Courts of Panama City will be competent to resolve all types of issues.

FORCE MAJEURE

JOYA LIFE’s commitment to full or partial compliance with its obligations will be suspended in case a fortuitous event or force majeure prevent or delay its implementation.

Without limiting the list, wars, riots, social unrests, strikes and problems of supply not attributable to JOYA LIFE will be considered as such.

JOYA LIFE will inform the client in case of a fortuitous event or force majeure within not more than 15 days after its occurrence. In case of any suspension period of more than one month, the client should be able to suspend his current order and proceed to a refund under the conditions indicated by e-mail, depending on each particular case.

ORDERING ARTICLES

All orders are handled in the languages offered on the Web site to the client, user or purchaser, under the forms allowed by the Web sites.

Photos, graphics and descriptions of products proposed in the sale on the Web sites are only indicative and the clients, users or purchasers are expressly informed that some articles can seem slightly bigger or smaller than their real size, due to the default screen setting and photograph techniques or audiovisual media. Other articles may appear bigger than their real size, for the purpose of showing their details, or smaller than their real size, for the purpose of showing the entire product.

JOYA LIFE commercializes handcrafted products, made of natural raw material, produced by hand with products, minerals, precious and semi-precious stones, making each piece unique. Consequently, clients, users and purchasers are expressly notified that no two pieces are ever exactly the same considering their shape, color, stone, material design and all its components, due to the artisanal technique used by JOYA LIFE. In addition to that, all products including a silver, gold, leather or any other material chain may have a different size, design, thickness and quality, according to JOYA LIFE stock and its providers’ availability.

PRICE AND CURRENCY CONVERSION

For some countries, the prices on the Web sites are available in their own currency, and others are only available in American dollars (USD), according to the information and selection of the country where the website is accessed from. For international orders, your credit card issuer will identify the exact exchange rate to be charged. The quantity withdrawn from the original source of payment will be returned in its entirety when it is returned by the seller. Note that we will not be held responsible for the possible discrepancies caused by the exchange rate fluctuations. TERMS OF PAYMENT

Clients, users or purchasers may use a credit card, bank transfer or any other payment method offered by the Web site when selecting the product, article or service of their interest.

Payment is made at the moment your order is created. For this reason, the client, user or purchaser must provide all personal data and information requested by JOYA LIFE, and protect all his personal and financial data for the purpose of combating fraud. Nevertheless, JOYA LIFE will not assume any liability for fraudulent use of your information and payment methods used by any third parties.

INTERNATIONAL TRANSACTION FEE

JOYA LIFE is a Panamanian Company located in Panama, Guatemala and Argentina. If you are purchasing from outside Panama, your credit card company or bank may charge you a fee that might appear as charged by JOYA LIFE. This fee is not charged by JOYA LIFE, since this fee is charged by your bank or similar financial institution, because you are purchasing something from outside your home country. We will not refund this charge, since it was not charged by JOYA LIFE. Contact your Credit Card Company, bank or financial institution regarding this charge.

We take active measures to ensure full security of your credit card details and personal information. In addition to processing every credit card sales through a fully secure and reputable third party service, the payment is protected by the industry standard, to protect your private data.

TAXES

Please note that JOYA LIFE does not collect certain taxes that are compulsory in some countries, and JOYA LIFE does not benefit from them in any way. The prices announced do not include taxes that could be generated in your home country for purchase or shipment.

If the product or service purchased in JOYA LIFE generates taxes to pay, JOYA LIFE will not be responsible for providing this information. The client, purchaser or user must ensure that the selected shipping company gives such information to the personal data he provides to JOYA LIFE. Moreover, JOYA LIFE does not accept product returns or refunds related to the non-liberation of a product due to tax expenses that were not paid by the user, client or purchaser, generated by shipment.

PRICE AND SHIPMENT

The prices shown are only of an indicative nature and have no contractual value. These prices correspond to the prices recommended and stablished by JOYA LIFE in all its stores, and are subject to change without prior notice. As for the jewelry, products and services presented on JOYA LIFE’s Web page, the indicated prices correspond to the material and raw material duly identified in each product or service, and are also subject to change according with bigger or smaller sizes.

The prices of products and services do not include shipping costs. Note that the shipping service is provided by companies unrelated to JOYA LIFE, and these costs are borne by the client, user or purchaser, except for free shipping offers on JOYA LIFE websites. To buy JOYA LIFE’s products or services, the user, purchaser or client must choose the shipping company and method offered by JOYA LIFE websites, otherwise, it will be understood that the client, user or purchaser expressly accepts JOYA LIFE’s selection, which implies on the client, user or purchaser’s acceptance of the deadlines, services and costs that could be generated if free shipping is not available.

SHIPMENT AND POST-SHIPMENT VERIFICATION

Please ensure to enter the correct billing address and contact information as appears on your bank statement or credit card. Transactions might be unauthorized if the information entered does not exactly coincide with the information contained in your bank or credit card provider. Some transactions may also be considered for subsequent verification by our Customer Service team. Ensure to introduce the correct shipping address (number and name of the street, city, state and postal code, and any other information considered necessary for us to locate your address and make a successful shipping), since we are not responsible for parcels sent to the wrong address when the address information is not correctly introduced. We want to make clear that we will not resend such parcels or refund such purchase, because informing us with the correct address is the responsibility of the user, client or purchaser.

SHIPMENT

None of the prices on the Web sites include worldwide shipping costs. Your JOYA LIFE products will be shipped from our warehouses, located in the city of Antigua Guatemala, Republic of Guatemala.

Please allow 1-4 business days to process your order, regardless of the shipping option selected at the time of payment. Orders are shipped from Monday to Friday, excluding weekends and bank holidays. Immediate shipping is not available. Please allow up to 2 business days for your shipping order (if you place an order on Monday, your parcel may be shipped until the following Friday). You will receive a tracking number once your order is shipped. Express and other shipping options are not refundable, in case you paid for them.

We introduced DHL as our shipping provider. International orders will now be sent from our warehouse in Antigua Guatemala, Guatemala (subject to availability).

JOYA LIFE is not able to know if shipping is possible to certain countries, depending on the shipping method you or JOYA LIFE select or your country’s social situation and customs.

Very rarely, international shipping to some countries may take 4-8 weeks due to the slow customs operations in these countries. We are not responsible for delays caused by the customs clearance processes of the destination country.

i. TRACKING YOUR ORDER

After your payment has been made, you will receive an e-mail once we have processed your order (this may take up to 96 hours). You will receive a confirmation by e-mail once your order has been shipped, which will include your tracking number and a link to follow your parcel. If there is a problem with your tracking number or parcel, please contact your courier before contacting us. Please allow 1-4 days to receive information regarding your shipment. In some rare cases, your shipment information may not be updated, but you will still receive your order.

ii. INTERNATIONAL FEES AND DUTIES

All international customers are responsible for paying the custom fee, taxes, duties etc. upon receiving the order. These fees are paid to the government and are not collected by JOYA LIFE, therefore they cannot be reimbursed.

The parcels are sent with unpaid duties and taxes, which means that these duties or taxes are not included on the price of the products you purchase from JOYA LIFE Web sites. Any applicable fee must be paid by the purchaser in order to receive the parcel. Because we are not able to indicate the amount of fees to pay, we recommend you contact your country’s customs office or tax deduction agent for information about the respective duties and taxes for a parcel that comes from outside your country.

Note that for some services, DHL pays for the duties and taxes that must be paid once the parcel enters the country. This simple process guarantees the collection of mail and its rapid delivery to the designated address. Products shall be released only after all duties and taxes are paid on your behalf. In certain occasions, you may receive a DHL invoice after the delivery of your parcel, for the taxes which have been paid on your behalf and according with its destination, plus a small administration fee.

iii. INCORRECT ADDRESS

It is the responsibility of the purchaser to ensure that he provides the correct shipping address. We make every effort to speed up the processing and shipping, and there is no chance to cancel / change your order or the shipping address. Additional delivery charges: If the parcel returns to us due to an incorrect address and you wish to receive a refund, you will not be refunded.

Parcels will only be delivered to the user’s permanent home. It is understood that parcels will not be delivered to hotels, business addresses or PO boxes.

iv. DELIVERED BUT NOT DELIVERED

If tracking information confirms that the article has been delivered to your address, but you have not received it, please contact the local mail and DHL members to investigate the issue. We will not be held responsible for parcels which tracking information states that it has been delivered to your shipping address. JOYA LIFE assumes no liability if a third person, unrelated to the user, receives the product or service on the user’s behalf, or time of delivery.

v. INSURANCE

JOYA LIFE informs that the days for receiving the product or service may vary according with the company of your choice. Moreover, the insurance policies of the product vary according with the shipping method and company of your choice, which you expressly agreed to if JOYA LIFE offers you free shipping, and in some cases it should be noted that certain shipping methods and companies do not provide insurance for the product or service, and in such cases, JOYA LIFE is not responsible for refunding the price paid for the loss of the item on shipment, since it is not associated with the shipping companies. In addition, JOYA LIFE accepts no liability for insurance collection management in the specific and exceptional cases when your shipment is insured by the shipping company. These proceedings must be made by the purchaser, user or client. JOYA LIFE cannot be held responsible if the external appearance of the parcel is not perfect, since this is attributed to the Courier service and mail service selected by the client.

RETURN OR EXCHANGE POLICY

JOYA LIFE accepts articles as credit for other JOYA LIFE products or articles, or exchange for another article or product of the same type, with no refunds, and if they are returned according with the policy detailed below and the Terms described above.

JOYA LIFE allows for clients, users or purchasers who are not satisfied with the articles or services to exercise their right to return or exchange the article or service. In the event that the client, user or purchaser wishes to exercise his right, he must do it within one day after having received the product, article or service, and this information shall be checked with the shipping company of his choice, under the following procedure.

Notify JOYA LIFE in writing by the e-mail info@joya.life, indicating the reasons why he decided to exercise his right.
The only acceptable causes are receiving a product different to the one requested, and notorious for poor quality of the product, article or service. Note that JOYA LIFE commercializes handmade products and articles made of natural raw materials, therefore the symmetry or asymmetry of the pieces, their rustic features coming from the manual process they are made, or their inappropriate use are not qualified as poor quality.
Ensure that the products have been appropriately used and looked after, since JOYA LIFE uses leather products and natural materials with handicraft techniques to prepare its articles, which may contain imperfections and color variations that only enhances the beauty and exclusivity of your article. Moreover, external elements such as excessive heat or humidity may affect the generalaspect of your product. If it is properly used and stored, the durability of your product is guaranteed. When the product is not being used, keep it in the protective bag that comes with it.
Having followed these conditions and taken appropriate care of the product, you must return the product in its original packaging, with the complete accessories, user guides, related accessories, protections, tags, instructions, pamphlets and others, with a copy of the invoice to the following address: 4 Avenida Sur, casa número 10, Antigua Guatemala, Sacatepéquez, República de Guatemala.
The client, user or purchaser shall pay for costs of return, which implies that the articles must be returned by Registered Mail or any other means that prove the correct date. The customer is liable for the costs and the risks of the return dispatch.
The right of returning or exchanging the product is for exclusive use of the client, user or purchaser, and cannot be exercised by a third party.
Any exchange or new delivery can only be performed after the product, article or service is received in JOYA LIFE.
The article to be exchanged will be inspected to see if it qualifies for an exchange.
If there is a price difference due to the exchange of the product, this difference may be refunded through a shopping voucher of the same value.
At the end of the period of thirty days of receiving the product, article or service, JOYA LIFE holds the right to refuse your request for exchange or return.
JOYA LIFE holds the right to refuse more than two subsequent returns or exchanges for articles, products or services purchased.
In consideration of their genuinely personalized nature, personalized articles shall not be returned, refunded or exchanged. Therefore, the policies above are not applicable to them.

C. INGREDIENTS

100% jadeite jade stone, manually carved and polished without any chemical treatment or dyeing

Note: Jade egg often does not have a continuous look, but shows areas of streaks or cloudy patches (internal cracks) within the stone, or looks somewhat milky due to minute inclusions of foreign substances within the stone. These are NOT defects. If you boil your jade egg, please put your jade cold water then heat it. Putting jade egg into very hot water may cause cracks on the egg.

JOYA LIFE VIRTUAL GAMES

User conduct

You shall download and connect to and play our Games only for your personal use and according to these Terms of Service, any app store and platforms terms and applicable law.

You shall only download and play our Games and acquire Virtual Items from the app stores and platforms that we make our Games available on, and only play our Games on devices and platforms that we provide the relevant Game for.

You shall not interfere with our Games and gameplay inside our Games irrespective of whether this includes manipulation of the software, backend or networks. And without limitation you shall not:

Create, offer or use hacks, cheats, exploits or any other unauthorized application, tool or command that modifies the Game or gameplay or circumvents technical protection measures in a way not intended by Joya Life;
Decompile, disassemble or reverse-engineer our Games;
Create, offer or use any malware (e.g. computer viruses, Internet worms, Trojan horses, hoaxes, dialers);
Offer, provide or acquire our Games or Virtual Items by means other than explicitly facilitated by Joya Life;
Spy on Joya Life, its Games or any other services or users or collect data unauthorized;
sell and transfer a Game account.

If provision of information or data is required, you must provide all of these accurately and keep them up-to-date at all times.

User communication and content

Our Games may allow you to communicate with other users and post content (e.g. texts, pictures). When you interact with other users or make content available via our Games, you shall not:
1. Post or use any communication or content that breaches applicable law including third-party rights, e.g. rights in intellectual property, rights to confidentiality or rights to privacy;
2. Post or use any communication or content that is abusive, unethical, racist, obscene, pornographic, discriminating, harmful to minors or glorifies violence, or is objectionable in any other way;
3. Insult, threaten, provoke or harass others including other users as well as Joya Life and its employees and partners, for example, by using abusive language, stalking or spamming;
4. Post or use any communication or content for commercial purposes;
  link or refer to any source outside our Games that is in breach of this terms, in this context only the provider of the technical means to communicate or make content available, is neither obliged nor able to monitor communication or content made available by you or other users via our Games, and does not assume any liability to that extent. Any person that makes communication or content available via our Games remains solely responsible for such communication and content, so you remain responsible for your communication and content. You shall indemnify Joya Life against all and any claims that are brought against Joya Life as a result from your breach of this terms, unless not caused by your fault.

Joya Life reserves to remove any such communication or content, if we have reasonable ground to believe them to infringe third party rights or any other applicable law. If you believe communication or content made available via our Games infringes your rights or is in breach of these Terms of Service, please notify us at info@joya.life
By making communication or content available via our Games, you grant Joya Life a permanent right to use your communication and content for display inside our Games, to publish your communication and content in all media and to adapt them for this purpose. You may withdraw from this grant of rights by giving appropriate notice to Joya Life at info@joya.life .

Liability and limitation of liability

Nothing in these Terms of Service shall limit Joya Life´s liability where applicable law does not allow for such limitation. In particular Joya Life’s liability shall not be limited:

For death or personal injury from Joya Life’s or any of our statutory representatives’ or agents’ negligence or malice;
For any other kind of damages and loss from Joya Life’s or any of our statutory representatives’ or agents’ gross negligence or malice or fraud;
in case Joya Life has assumed an explicit quality guarantee;
Joya Life’s or any of our statutory representatives’ or agents’ slight negligence, if this causes a breach of an essential obligation under this User Agreement (obligations that need to be fulfilled in order to achieve the purpose of this User Agreement and on whose fulfillment a User can usually rely upon). In this case, Joya Life’s liability shall be limited to predictable damages and losses that usually occur in these cases. Any further liability of Joya Life is excluded.

Contract duration and termination
This User Agreement runs for an indefinite term.

Either party may terminate this User Agreement at any time by giving 30-days notice (written or electronic communication, e.g. via e-mail, required). You may also terminate the User Agreement with immediate effect by deleting the Game from your device or removing the Game from your Facebook, apps and others.

If we have reasonable ground to believe that you are in material breach of these Terms of Service, we may suspend your access to our Game and/or terminate this User Agreement.
4 Either party may terminate the User Agreement for cause without giving notice. Grounds for such termination for cause include material breach of these Terms of Service.

Upon expiry, you will no longer be able to access the Game that was the subject matter of the User Agreement. Your in-game progress and any other Game-related data will be deleted. Only if Joya Life continues to operate the Game, you may again download the Game or access the Game on apps, Facebook or others whereby a new User Agreement will start to run. However, any game-related data cannot be restored.

Final provisions

Joya Life may transfer all or a part of its rights or obligations pursuant to this User Agreement to a third party without your consent. You may transfer any of your rights or obligations under this User Agreement only with our prior written approval.

We reserve to amend these Terms of Service at any time. We will notify you about amendments by a special notice no later than four weeks before such changes take effect, either by notification inside the Game or in the description of a Game update on a Platform. You may object to the changes within four weeks from such notice. If you do not object within four weeks, the changes shall be deemed accepted by you. If you object, we may terminate this User. When we notify you about the amendments we will also inform you about the deadline for objecting to the amendments and consequences if you fail to object.

This User Agreement is governed by Panamá law, If your place of residence is outside of Panamá at the time you enter into this User Agreement, mandatory provisions of law in your jurisdiction concerning applicable law shall remain unaffected and apply.
